Terms of Service

These terms govern your use of the AuroraSpy mobile application and the website at auroraspy.com (together, the "Service"), operated by Brynjar M. Bjornsson as an individual undertaking in Iceland ("AuroraSpy", "we"). By installing the app, creating a sighting, joining the waitlist, or otherwise using the Service, you agree to these terms. If you do not agree, please do not use the Service.

1. What the Service is — and what it is not

AuroraSpy provides aurora-viewing guidance: a calibrated probability, timing windows, cloud context, and other interpretive cues derived from public space-weather and meteorological sources. It is a forecast, not a guarantee. The aurora is a natural phenomenon and may not appear even when conditions are favourable; conversely, it may appear when the forecast is cautious. You should treat AuroraSpy as one input into your own decision, not as a promise.

2. No safety or travel advice

Iceland's weather, roads, and remote areas can be dangerous, especially at night and in winter. AuroraSpy does not provide driving, hiking, road-condition, avalanche, marine, or other safety advice. You are solely responsible for your own safety and for following official sources such as safetravel.is, vegagerdin.is, and vedur.is. Do not make safety-critical decisions based on AuroraSpy alone.

3. Acceptable use

You agree not to:

  • use the Service in a way that is unlawful, abusive, or harmful to other users;
  • scrape, copy, or redistribute the forecasts or sighting feed in bulk without prior written permission;
  • attempt to reverse-engineer, decompile, or bypass any access controls;
  • upload sighting photos or text that infringe someone else's rights, contain personal data of third parties without consent, or are illegal, hateful, sexually explicit, or violent;
  • impersonate another person or submit deliberately false sighting reports.

4. Your content (sighting reports and photos)

When you submit a sighting report or attach a photo, you keep the rights to your content. You grant AuroraSpy a non-exclusive, worldwide, royalty-free licence to store, display, and use that content within the Service, including showing it to other users as community context and using anonymised reports to improve the forecast model. You can request deletion of your submissions at any time (see the Privacy Policy).

5. Notifications

If you opt in to push notifications, we may send aurora-related alerts (e.g. "aurora likely tonight in your area"). We aim to throttle these so they remain useful rather than noisy. You can revoke notifications in your phone settings or in the app at any time.

6. Availability, changes, and beta status

The Service is currently in early access / beta and may be unavailable, slow, or change without notice. We may add, remove, or modify features at any time. Forecast logic is updated periodically as we calibrate against observed outcomes. We will not be liable for unavailability or changes.

7. Free vs. paid features

Core forecast guidance is currently free. If we introduce paid features in the future, the price, billing cycle, and refund conditions will be presented before purchase and these terms will be updated to reference them.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that the forecast will be correct, that the aurora will appear, or that the Service will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, AuroraSpy (and its operator personally) will not be liable for any indirect, incidental, consequential, special, or punitive damages — including loss of time, travel costs, missed sightings, or lost opportunity — arising out of or in connection with your use of the Service. Nothing in these terms limits liability for fraud, wilful misconduct, or anything else that cannot be limited under applicable law.

10. Termination

You may stop using the Service at any time by uninstalling the app and requesting deletion of any data you submitted. We may suspend or terminate access for users who breach these terms, abuse the system, or where required by law.

11. Privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these terms by reference.

12. Governing law and jurisdiction

These terms are governed by the laws of Iceland. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the Icelandic courts, without prejudice to any mandatory consumer-protection rights you have in your country of residence.

13. Changes to these terms

We may update these terms as the Service evolves. The effective date at the top of this page will change accordingly. Material changes will be highlighted in-app. Continued use of the Service after changes take effect means you accept the new terms.
